Removal of PD Rights Successfully Challenged at Appeal
Rob Duncan Planning Consultancy Ltd. has recently appealed the imposition of a planning condition that removed permitted developments on a residential development. The Local Authority had imposed the condition removing permitted development rights owing to vague and generalised concerns about what might possibly occur on the site by way of permitted development. Rob Duncan Planning Consultancy Ltd. successfully demonstrated that the condition did not meet the test of necessity or reasonableness and that the Local Authority’s concerns were unfounded. The Planning Inspector agreed and allowed the appeal.
